College of DuPage will remain incorporated in Glen Ellyn under an agreement reached by both entities Wednesday with a DuPage County Circuit Court Judge following a lengthy legal battle and attempts from the college to deannex from the village, officials said.
Under the five-year agreement, the college will pay village taxes and the village will continue to serve the college with water and sewer at residential rates. Meanwhile, regulatory control and authority over the college campus will be transferred from the village to DuPage County, according to statements from the college and the village.
After five years, the parties will have the option to renew the agreement or proceed with deannexation, which the college said late last year was its intent.
Officials from the college and the village both said the compromise is good for taxpayers.
“This agreement meets the interests of both parties,” Village President Mark Pfefferman said. “The village is strongly opposed to disconnection. With this agreement, we have every faith that the college will remain in the village in perpetuity and that the two institutions will be stronger partners with the county’s assistance.
COD President Robert Breuder said “we look forward to a mutually beneficial relationship with the village going forward.”
