An Antioch restaurateur has been bailed out of jail following his arrest this week on charges that he was texting on a cell phone and intoxicated when he struck and killed a man with his car.
David Maish, 40, of Antioch, was released from Lake County Jail Thursday after posting $25,000 bail on charges of reckless homicide and aggravated DUI, officials said.
Maish is accused of being above the legal limit for alcohol, intoxicated with the prescription painkiller hydrocodone and using an electronic device to send or read text messages when he struck and killed a Round Lake man, Santiago Balderas, with his car on Feb. 6 in Antioch, according to authorities and court records.
Maish is a chef and owner of David’s Bistro in Antioch.
The investigation that led to Maish’s arrest took several weeks and involved examining phone records and waiting for blood test results, Lake County Assistant State’s Attorney Suzanne Willett said.
“These are serious charges,” Willett said. “We wanted to make sure we conducted a thorough investigation.”
A forensic investigation still underway will determine exactly how Maish’s mobile device was being used when the accident occurred, Willett said.
She also said that, if convicted, Maish faces a three- to 14-year sentence.
Baldares was walking south on Illinois Highway 59 just after 9 p.m. when he was struck, police said.
Someone who answered the phone at the restaurant said Maish would not be available to comment. A woman who answered at his home also declined comment.
